Definitions and Interpretations in these Conditions

The 'Company' shall mean LanguageOnSale. 'The Client' shall mean the person in whose name the booking is made and shall include the person or persons on whose behalf the same is made. The ‘Language School’ shall mean the actual physical place where the language course is conducted and a sovereign and legally independent entity. The 'Service' shall mean all the products that can be purchased on this website. 'Force Majeure' shall mean any event outside the Company's control, which prevents the prompt performance of its obligations, including war and civil strife, etc.

Accommodation

One week accommodation bookings mean 6 nights, two weeks mean 13 nights and so forth (unless otherwise indicated). You will not be entitled to any refund if you spend fewer nights in your accommodation than booked.

Language Courses

The number of language course lessons and their duration depends on the particular Language School's practice and the type of course. Typically, one lesson may last from 40-60 minutes. The number of minutes per lesson is shown on the website. The exact number of hours may be somewhat reduced due to the initial level test which usually takes place on the first Monday of the course (the first 2 lessons are sometimes missed, and very rarely the whole of the first Monday is missed). There may also be some missed hours due to evaluation testing during the course (often on Fridays every 2 or 4 weeks). The Company does not accept any liability for lessons missed due to these reasons and no refunds will be given where lessons are missed due to testing. In the rare event that you are the only student of your level, and you are enrolled on a group course, the Company may offer you individual tuition up to the value you have paid for group classes, rather than put you in a class at the wrong level.

The Company will not make any refunds to a Client who applies for a language course requiring a specific level and is then found to be unable to join the course after the initial level test. In this case, the Client will be offered a suitable alternative and any difference in price will be refunded or requested by the company. However, this also depends on the terms and conditions of that specific Language School and the suggested alternative. In cases where there are insufficient numbers to run a group class, a reduced number of individual classes may be offered or the course may be offered at another school in the same city of similar standard.

After having received the payment from a Client, the Company will send a confirmation of enrolment together with an invoice. A welcome pack with more practical information will also be sent to you a couple of working days after the confirmation.

Materials and Transfers

Each language course indicates whether or not the course material is included in the price or not. If it is excluded then the course material price is shown. The actual prices may vary a bit from the displayed ones.

Airport transfers and the cost of activities and excursions are not included except where specifically stated. However, the latter is normally voluntary.

Activities and Excursions

Descriptions of activities and excursions, which accompany the language courses, are for guidance only, unless specifically noted in the confirmation invoice. Some activities may not run at all or may be substituted by other activities. In low season, there may be no organized activities whatsoever.

Public Holidays

Where a class lands on a public holiday, no lessons will take place on that particular day and no there will be no reduction in price except where specifically stated. Individual classes are usually rescheduled (but not always) but group classes are usually forfeited. Please visit http://www.qppstudio.net/publicholidays.htm to find this year’s public holidays. The Company is not responsible for the contents of that link. It is the Client's responsibility alone to familiarize oneself with the target country’s public holidays.

Booking and Payment

No contract is made between the Company and the Client and no booking is valid until the Company has issued a confirmation invoice by e-mail. The Company will issue this confirmation invoice after it has received a completed booking form with all data needed and the entire payment. It is recommended that the visa requirements are investigated and also the travel availability before booking a course.

If it turns out that the personal data is intentionally invalid, the Company reserves the right to cancel the Client's booking without any refunds.

When booking any Service for minors, authorization from their parents or legal representative will be necessary. Authorization must be properly legalized by a public notary and carry the due apostille under the terms of the Haag convention of 1961.

Prices and Surcharges

The charges, which make up the total price including any applicable supplements and surcharges, will be as stated on our website. Prices in any printed brochure supplements, advertisements or other materials are for indication only. The prices on the website are valid but can be subject to change at any time. Once a course is booked, the prices will not change, even if they are changed on the website.

Currency conversion

The Company is updating the currency exchange rate on a daily basis from an external provider: http://finance.xaviermedia.com. In case the provider fails to update the exchange rates the Company will use the one from the day before. However, the price and its corresponding currency in the "Payment details" section just before a booking, will always be the dominating one. That price will be the one deducted from the Client’s bank account if he/she books a language course.

Alterations by the Company

The Company will do its utmost to provide the arrangements that have been confirmed, but it must reserve the right to modify or cancel any language course or accommodation if unforeseen circumstances arise. If the Company cancels or significantly alters an essential element of the Client's holiday for reasons of force majeure, the Company shall inform the Client as soon as possible and shall offer them the choice of an alternative holiday of at least comparable standard if available. If the Company is unable to offer an alternative of similar price, the Company will offer the nearest available alternative and will refund the difference paid by the Client. If force majeure occurs while the holiday is in progress, the Company will try to make reasonable alternative arrangements.

Liability of the Company

The Company accepts responsibility for ensuring that all parts of the course are supplied as described and that all services shall reach reasonable standard. However the Company shall not be liable for the failure or improper performance of these services where such failure or improper performance is attributable to a) the fault of the Client, b) the unforeseeable or unavoidable actions of an unconnected third party, c) unusual and unforeseeable circumstances beyond the Company's supplier’s control, including force majeure.

Parents of minors agree that neither LanguageOnSale, the Language School nor the host family shall be liable for damage or problems caused either negligently or intentionally by their children while participating in trips. Parents and their children who are still minors recognise and accept the laws and the normal code of conduct of the country, which they are visiting.

Clients are responsible and consequentially financially liable for any damages caused by their actions involving the school, accommodation, voluntary program or internship, workshops or any other facility where the Service takes place.

Alterations by the Client

If the Client wishes to change their booking in any way after the confirmation invoice has been issued, they must inform the Company immediately, in writing. The Company will reserve the right to charge € 100 per person to cover the additional administration involved with the alteration and any charges imposed by Language Schools (details available on request). Further, any difference in price between the alteration and the original choice will be refunded or requested by the Company. The Client will be obligated to pay for all transaction fees.

Cancellation by the Client

If the Client wishes to cancel the booking he or she must either sign in on the website and do it online or send us a signed letter with a copy of the passport. The date of cancellation will be taken as the date that the Company receives the letter.

Different cancellation charges apply depending on the number of days between the cancellation and the service start. These charges will only apply on actual bookings, which means after LanguageOnSale has received the payment. Otherwise no charges will take into effect.

  • 49 days or more: 100% of the total amount except 30 euro administration fee and all transaction fees will be paid by the Client.
  • Between 28-48 days: 62% of the total amount will be refunded and all transaction fees will be paid by the Client.
  • Between 8-27 days: 32% of the total amount will be refunded and all transaction fees will be paid by the Client.
  • Between 1-7 days: No refund.

If the Client cancels the booking after a language course has started there is no refund for any course, accommodation or other item booked. Further, No refunds will be given for flights or other travel products.

Insurance

Neither agent, operator nor the Language School will be held responsible in any way for any accident, illness, loss of personal effects or change in personal circumstances arising at any time prior to or during the course.

General

The Company honestly believes that all statements made in its brochure or website are factual and correct. Every reasonable effort has been made to describe the Language Schools and environs and to provide the amenities described. The Company cannot therefore be held responsible for any changes that become known after the brochure was produced (up-to-date information can be found on the website), nor can the Company accept liabilities for happenings outside its reasonable control. The Company undertakes to advise the Client of any material changes known to it prior to the Client's departure.

The contract incorporating these conditions shall be governed by Danish law and any matters arising out of it shall be subject to the jurisdiction of the Courts of Denmark.
